In fact Dave I didn't look at her profile, but I knew that she was a recent 'uploader' making the mistake of not looking back, but it doesn't alter the fact that it's my image.

Whether or not she gets banned will be the decision of C&S but I might suggest she makes a donation to POE with a warning, in order for me not to take action against her for copyright.

She just wrote back to me saying:

I really have no more details.  Its taken in Hever Castle's rose garden.  Taken with a FUJIFILM FinePix Z90 point and shoot camera.  Was a lucky shot.

If she has only uploaded the image from her computer today al the info will be avaiable to her. The camera she says she used does tie in as it was released in Jan 2011. But why is there no info showing up on POE as with the rest of 'her' images today which as Ruth so rightly points out are taken on a phone!!!

A donation i think is the minimum, but how about a public apology here in the forums. She cannot blame naivity or lack of legal knowledge for downloading someone elses picture as she as stated the camera she used.

Lucky shot!!!! She is taking out of where the sun don't shine Ron. As I said before, the images are IDENTICAL even down to file size on POE. The sheer unlikely-hood of two people taking an identical shot with two totally different cameras is simply impossible, and to get the exact download size on a web size muist be just as impossible.

I have 'spilled the beans' and written to her again asking for an explanation and an apology. I have also made one or two suggestions in an attempt to resolve this matter as I own the Copyright.

I need to know that she hasn't done the same thing to other POE members images. I need an assurance or two and have suggested she may like to make a donation to POE  for her 'mistake' thus bringing the matter to a conclusion, we shall see what happens.

If nothing is forthcoming I will ask C&S to delete her account, because her action is totally unacceptable.

I have suggested she make a donation to POE for her mistake and I will then get the image removed.

That leads me to think that she has obviously downloaded it to her pc at somepoint, without permission!!! And as to 'accidentally mixed it in' I find that hard to believe. But you have your apology Ron and a promise to remove the image from the site. So at the end of the day I think a good result resolved quickly and hope she has learned a valuable lesson. Personally I would be inclined to accept the apology and if a donation is forthcoming all well and good, if not put it down to experience and lets get with what POE is really all about
